This Privacy Policy governs your access to and use of the services, websites, and applications offered by Gurulab Sdn Bhd (the "Service"). Your access to and use of the Service is conditioned on your acceptance of and compliance with this Privacy Policy and our Terms of Service.

 This Privacy Policy aims to give you information on how Gurulab collects and processes your personal data, including any data you may provide through our websites and applications, and when you correspond with us, fill in a form affiliated to or provided by us, sign up to our newsletter or engage in our services or any other activities.

 As Gurulab evolves, our Privacy Policy will need to evolve as well during periodic reviews.  Any revisions to this Privacy Policy shall become effective on the date they are posted on www.mygurulab.com or in the Terms of Service. You are advised to review these regularly for any changes, as continued use is deemed approval of all changes. Likewise, it is important that the personal data Gurulab holds about you is accurate and current. Please keep us informed if your personal data changes during your relationship with us.

1. Personal Data 

1.1 Gurulab values and respects your privacy, and we are committed to protecting your personal data in accordance with the Personal Data Protection Act 2010 (PDPA) of Malaysia. By using Gurulab, you shall agree and consent to us to use and process your Personal Data. 

1.2 “Personal Data” means information about you, from which you are identifiable, including but not limited to your name, telephone number, birth date, identity card number, name of school, race, gender, religion, ethnic origin, home address, email address, credit or debit card details, name of family member, and any information about you which you have provided to Gurulab through direct correspondence by post, phone, email or otherwise, and in registration forms, application forms or any other similar forms and/or any information about you that has been or may be collected, stored, used and processed by Gurulab from time to time, including sensitive personal data such relating to education, health, religious or other similar beliefs.

1.3 The provision of your Personal Data is voluntary. Where we need to collect personal data by law, or under the terms of a contract we have with you, and you fail to provide that data when requested, we may not be able to perform our obligations under any contract binding both parties. (for example, to provide you with goods or services). In this case, we may have to cancel the Service you have with us but we will notify you if this is the case at the time.

2. Automatically Collected Information

2.1 In addition, the Service may collect certain information automatically, including, but not limited to, the type of digital device you use, your device’s unique ID, the IP address of your digital device, your device’s operating system, the type of Internet browsers you use, your browsing actions and patterns, and information about the way you use the Service. As is true for most applications, we also collect other relevant information as per the permissions that you provide.2.2 We use a third-party credit card processing company to bill you for the Service. These companies do not retain, share, store or use personally identifiable information for any other purpose.[LSW4] We will receive personal data about you from various third parties and public sources.

3. Use of your Personal Information

3.1 We use the collected Information to analyse trends, conduct research, perform obligations under the contract we are about to enter into or have entered into with you, process and deliver the Service, make decisions about our continued engagement, manage our communications with you, administer and protect GuruLab and its websites and applications (including troubleshooting, data analysis, testing, system maintenance, support, reporting and hosting of data), deliver relevant website content and measure or understand the effectiveness and the safety of the Service, learn about each user's learning patterns and movements around the Service, and gather demographic data and usage behaviour about our user base as a whole.

3.2 Aggregated and individual,  anonymised and  non-anonymised data may periodically be transmitted to external service providers to help us improve the Service. We will share your information with third parties only in the ways that are described below in these Terms and Privacy Policy. We may use the individual data and behaviour patterns combined with personal information to provide you with personalised content and improve your learning experience.  Occasionally, some third parties may provide certain services which we may use to analyse the data and information to customise, drive insights and help us better your experience or reach out to you with more value-added applications, products, information, and services. However, these third-party companies do not have any independent right to share your personal data. 

3.3 GuruLab does not sell, trade, or rent your Information to any third party unless we have been expressly authorised by you either in writing or electronically to do so. We will get your express opt-in consent before we share your personal data with any third party for marketing purposes. You can ask us or third parties to stop sending you marketing messages at any time by contacting us at any time.

We may at times provide aggregate statistics about our users, customers, traffic patterns, and related site information to reputable third parties. However, this information when disclosed will be in an aggregate form and does not contain any of your Personally Identifiable Information.

3.4 GuruLab will occasionally send email notices or contact you to communicate about the Service or GuruLab in general, as they are considered an essential part of the Service you have chosen.

We may disclose Information:

  • as required by law, such as to comply with a subpoena or similar legal process;

  • to enforce applicable terms, including investigation of potential violations thereof;

  • when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, address security or technical issues or respond to a government request;

  • with our trusted services providers who work on our behalf, do not have an independent use of the information we disclose to them and have agreed to adhere to the rules set forth herein;

  • to protect against imminent harm to the rights, property or safety of the Service or GuruLab or its users or the public as required or permitted by law;

  • with third-party service providers in order to personalize the Service for better user experience and to perform behavioural analysis;

  • Any portion of the Information containing personal data relating to minors provided by you shall be deemed to be given with the consent of the minor's legal guardian. Such consent is deemed to be provided by your registration with us.

3.5 Additionally, we intend to use your data in direct marketing, and we require your consent (which includes an indication of no objection) for that purpose. In this connection, please note that:

  • your name, contact details (including address, contact number, email address), products and services information, transaction pattern, behaviour, background and demographic data held by us from time to time may be used by us in direct marketing; 

  • the following classes of services, products and subjects may be marketed in direct marketing: 

    • services and products related to our Services and/or our affiliates (including marketing affiliates programs we are a part of); 

    • reward, loyalty or privileges programs, promotional offers and related services; and 

    • invitations to events such as seminars/webinars/tele-seminars, conferences, live programs or events. 

3.6 We may conduct direct marketing via fax, email, direct mail, telephone, and other means of communication or send e-newsletters to you. You may choose not to receive promotional materials, by simply telling us (see below for contact details), and we will cease to do so, without charge. 

4. Data Security

4.1 We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition, we limit access to your personal data to GuruLab’s employees, agents, contractors and other third parties who may have a need to know or utilise such data. 

4.2 We have put appropriate technical and organisational security procedures in place to protect your personal data (including sensitive personal data) from loss, misuse, alteration or destruction. We aim to ensure that access to your personal data is limited only to those who need to access it. Those individuals who have access to the data are required to maintain the confidentiality of such information. We may apply pseudonymisation, de-identification and anonymisation techniques in efforts to further protect personal data.

4.3 If you have access to parts of our websites or use our services, you remain responsible for keeping your user ID and password confidential. Please be aware that the transmission of data via the Internet is not completely secure. Whilst we do our best to try to protect the security of your personal data, we cannot ensure or guarantee the security of your data transmitted to our site; any transmission is at your own risk.

4.4 We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

5. Data Retention

5.1 We will only retain your personal data for as long as reasonably necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting or reporting requirements. We may retain your personal data for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you.

5.2 To determine the appropriate retention period for personal data, we consider the amount, nature and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal, regulatory, tax, accounting, or other requirements.

6. Access to your Personal Information

6.1 We will provide you with the means to ensure that your Personal Information is correct and current. If you have filled out a user profile, we will provide an obvious way for you to access and change your profile from the Service. We adopt reasonable security measures to protect your password from being exposed or disclosed to anyone.

6.2 Under certain circumstances, you have the right to:

  • Request access to your personal data (commonly known as a “data subject access request”). This enables you to receive a copy of the personal data we hold about you and to check that we are lawfully processing it.

  • Request correction of the personal data that we hold about you. This enables you to have any incomplete or inaccurate data we hold about you corrected, though we may need to verify the accuracy of the new data you provide to us.

  • Request erasure of your personal data. This enables you to ask us to delete or remove personal data where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your personal data where you have successfully exercised your right to object to processing (see below), where we may have processed your information unlawfully or where we are required to erase your personal data to comply with local law. Note, however, that we may not always be able to comply with your request of erasure for specific legal reasons which will be notified to you, if applicable, at the time of your request.

  • Object to processing of your personal data where we are relying on a legitimate interest (or those of a third party) and there is something about your particular situation which makes you want to object to processing on this ground as you feel it impacts on your fundamental rights and freedoms. You also have the right to object where we are processing your personal data for direct marketing purposes. In some cases, we may demonstrate that we have compelling legitimate grounds to process your information which override your rights and freedoms.

  • Request restriction of processing of your personal data. This enables you to ask us to suspend the processing of your personal data in the following scenarios:

  1. If you want us to establish the data’s accuracy.

  2. Where our use of the data is unlawful but you do not want us to erase it.

  3. Where you need us to hold the data even if we no longer require it as you need it to establish, exercise or defend legal claims.

  4. You have objected to our use of your data but we need to verify whether we have overriding legitimate grounds to use it.

  • Request the transfer of your personal data to you or to a third party. We will provide to you, or a third party you have chosen, your personal data in a structured, commonly used, machine-readable format. Note that this right only applies to automated information which you initially provided consent for us to use or where we used the information to perform a contract with you.

  • Withdraw consent at any time where we are relying on consent to process your personal data. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent, we may not be able to provide certain products or services to you. We will advise you if this is the case at the time you withdraw your consent.

7. Cookies 

7.1 We send cookies (small files containing a string of characters) to your computer, thereby uniquely identifying your browser. Cookies are used to track your preferences, help you login faster, and aggregated to determine user trends. This data is used to improve our offerings, such as providing more content in areas of greater interest to a majority of users.

Most browsers are initially set up to accept cookies, but you can reset your browser to refuse all cookies or to indicate when a cookie is being sent. Some of our features and services may not function properly if your cookies are disabled.

7.2 We use the following cookies: 

  • Strictly necessary cookies. These are cookies that are required for the operation of our website. They include, for example, cookies that enable you to log into secure areas of our website, use a shopping cart or make use of e-billing services. 

  • Analytical/performance cookies. They allow us to recognize and count the number of visitors and to see how visitors move around our website when they are using it. 7.3 Our website uses Google Analytics, a web traffic analysis service provided by Google Inc. (“Google”). Please refer to http://www.google.com/policies/privacy/partners to find out more about how Google uses data when you use our website and how to control the information sent to Google. 

7.4 You block cookies by activating the setting on your browser that allows you to refuse the setting of all or some cookies. However, if you use your browser settings to block all cookies (including essential cookies) you may not be able to access all or parts of our site and Services. 

7.5 Furthermore, you can prevent Google’s collection and processing of data by using the Google Ads Settings page or downloading and installing their browser plug-in (https://tools.google.com/dlpage/gaoptout).

8.1 We may present links in a format that enables us to keep track of whether these links have been followed. We use this information to improve our customised content. Clicking on links may take you to sites outside our domain. We are not responsible for the privacy practices of other websites. We encourage our users to be aware when they leave our site to read the privacy statements of each and every website that collects Personally Identifiable Information. These Terms and Privacy Policy apply solely to information collected by the Service.

8.2 The Service may contain links to external or third-party websites or resources. You acknowledge and agree that we are not responsible or liable for: (i) the availability or accuracy of such websites or resources; or (ii) the content, products, or services on or available from such websites or resources. Links to such websites or resources do not imply any endorsement by GuruLab of such websites or resources or the content, products, or services available from such websites or resources. You acknowledge sole responsibility for and assume all risk arising from your use of any such websites or resources.

9. Alerts

9.1 We may alert you by email or phone (through sms/call/Whatsapp/other means of communication) to inform you about new service offerings or other information which we feel might be useful for you.
